Judging by the patent, you can’t phase through surfaces, whether it is the entry and/or the exit surface(s), that are more than ~30 degrees from the horizontal. Generally as a rule of thumb Nintendo don't allow any patent applications to be published prior to them revealing a product if they actually plan to use that invention. I guess this doesn't really apply to software/in-game patents?
