News Garry's Mod is removing all Nintendo related Steam Workshop uploads due to takedowns (Update 3: who knows anymore)

IANAL but I've never heard of a DMCA takedown notice being "take down anything that uses our copyright". It's always the copyright owner telling the service provider which items infringe and should be removed.
 
It seems highly unlikely that Nintendo would resort to this 20+ years in, unless something went viral with their IP in it or something. Then again it seems Nintendo is on a roll lately removing all kinds of content so maybe this is part of a bigger global effort.

Something I noticed is that Pokemon clones/rip-offs are rapidly vanishing from App stores as well, but that may not be part of Nintendo's effort but rather Gamefreak/TPC. Not only that but fangames that have existed for years as well.

Maybe there is a correlation?

This is a great move from Nintendo tbh. They can disguise themselves as a copyright troll and then they can blame the 'troll' essentially freeing them from blame.

Nintendo is a special sort, even during the failing Wii U years we have the madness that was that youtube creator's program and the mass deletions.

They just seem to have oddball years where they do nothing but push fan's buttons.

EDIT: Actually it seems a racist video involving Mario models in GMod might have gone viral? That's one way to get a company to go scorched earth on fan creations.
If this is true then this is likely the reason Nintendo is suddenly taking action like this, though no one seems to be talking about it.

I was a bit cautious to weigh in denoting either side until it developed. Man, it may be fun to just dunk on Nintendo for having one foot in the past as far as their hardware is concerned, it's good to have a giggle when they make a Nintendo-Ass move like the E-Reader or Amiibo, but when they do shit like this, it makes me genuinely wonder why they want to be so Anti-Consumer. People will co opt anything to be a mouthpiece for shock-value/hate speech.

Well this development genuinely sucks. I wonder what exactly prompted this. Change of management? Emboldened by Yuzu? Switch 2 launch preparations? Like with covid was there a swell of new PC gaming and the console market shrinking from the rising costs of game development mixed with the ease of switch, 3ds, and wii u hacking making nintendo want to take these measures after all this time? Especially with Microsoft and PlayStation putting their games on PC making the platform seem like more of a threat. Speculating is all

It's probably a lot of things coming together at the same time. A few things came to mind.

1. Nintendo has historically been hostile to fan creators and fan creations, and and just anything they generally don't have control over. That if nothing else could simply be the reason, and the amount of Gmod content using their IP has reached a point that they no longer want to ignore.

2. I mentioned earlier in the thread that this is a shortsighted decision. Why? Because there are a lot of YouTube channels and series targeted and kids and teens that use Gmod with Mario assets. Nintendo functionally has a very limited multimedia pipeline outside of the recent Mario movie. There are no cartoons, no YouTube content, etc., that would hit kids in the way that some this Gmod stuff does currently. My point is, that with the expectation of more Nintendo movies on the horizon, and possibly other things in the works with the new "Nintendo Pictures" animation studio, they may see this as the time to clamp down on media that uses their IP, particularly if it's being used in ways they don't really like.

3. Switch 2 is upcoming, and with that a host of new games and potential media content that uses their IP. Going back to point to, this probably affects their decisions on what they want to go after.

4. With the rise of AI, particularly for video and voice content, Nintendo may be laying the groundwork for future lawsuits or DMCA notices depending on what content comes out of these big AI models, and/or what content is being fed into them.

Anyway everything about this seems really dumb and shitty on Nintendo's part.
 
Thank you Nintendo for protecting me from being exposed to copyright infringement. I can now safely use gmod again.

It's still a dumb reason. People will make all sorts of dumb shit in GMod and there is zero chance GMod users are claiming it's official nintendo stuff so it very obviously falls under parody. What next is nintendo going to try to get Rule34 nintendo content taken down?

Wouldn’t be surprised if someone set them off by pointing out a bunch of these using ripped assets from actual Nintendo games. That’s always been a gray iffy area

Huh, is this on the clock app or something? It's possible this is the catalyst but who knows really.

I'm surprised they let things like this go on that long. It goes beyond Garry's Mod, there's tons of straight up ripped Nintendo content available by Steam Workshop. Want to use ripped Xenoblade models in Final Fantasy XV? Valve is there to make it easy.
 
People convincing themselves this is definitely a copyright troll because some emails don't line up with the usual public emails not from the legal department is giving me a lot of flashbacks.

Called it. The replies to the Garry Newman tweet being a bunch of "no it's gotta be a troll I know more than you cause I saw a tweet that was wrong" would be funny if Nintendo wasn't being such an asshole.
 
what would even be the purpose of TRYING (good luck) to remove a shit ton of nintendo-related content from a community hub (that doesn't even monetize them) of a game that doesn't even come with said assets?

Honestly, the fact that he hasn't even contacted Nintendo about this makes me suspicious. He's already in the process of taking stuff down, so what's the problem? If he contacted Nintendo, and they said it was them, or that it wasn't them but have now been notified and expect him to take the stuff down, then he's already got a head start. But, what if they were actually okay with them?
 
Probably contains some weird borderline porn Nintendo models or Not-Safe-For-Children models. Anyway, most of the crying are from non-nintendo customers.

mm-nintendo.com is registered to MarkMonitor(mm), a company that specialises in preventing "internet counterfeiting, fraud, piracy, and cybersquatting.". This is Nintendo having MarkMonitor do what they do.

Seriously shocked nobody I've seen has done a simple WhoIs search on it then looked up the resulting registering company. It's an anti-piracy service affiliated with Nintendo, what a shocker.

They aren't using the "wrong domain", they're using the domain specifically for dealing with this sort of thing. 🫡

To be clear, having special domains with no attached website specifically to host email addresses is not uncommon in the corporate world in the slightest, and mm-nintendo.com is an entirely functional domain registered to a trademark infringement and piracy monitor/deterrent service company.

The MarkMonitor website doesn’t really indicate that this is what they do (the "piracy" reference on Wikipedia is over a decade old). It seems like they just do domain management these days.
